MediaRadar, Inc. and its Affiliates ("We" and/or “MediaRadar”) are committed to protecting and respecting your privacy

This notice sets out the basis on which any personal data we collect from you, or that you provide to us, on mediaradar.com, winmo.com, aarpartners.com, catapultnewbusiness.com, magazineradar.com and vivvix.com (“our sites”) will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

Information we collect from you

We collect and process the following data on our site:

  • Information that you provide by filling in forms on our site. We may also ask you for information when you report a problem with our site.
  • If you contact us, we may keep a record of that correspondence.
  • We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
  • Details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

IP Addresses

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration. This is used to generate statistical data about our users' browsing actions and patterns.

 

Third-Party Service Providers

MediaRadar uses certain third-party service providers, as set forth in Annex A hereto, to operate and improve our services. These providers may collect personal data from you in connection with the services they perform on our behalf, as described elsewhere in this Privacy Notice.

 

Cookies

Our site uses cookies to distinguish you from other users of our site and to remember you between visits. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site.

A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your computer if you agree. Cookies contain information that is transferred to your computer’s hard drive. We obtain your consent before placing non-essential cookies on your device through our cookie consent mechanism. You may withdraw your consent or adjust your cookie preferences at any time through our cookie settings.

Some cookies we use are "analytical" cookies used by the Google Analytics external service. They allow us to recognize and count the number of visitors and to see how visitors move around the site when they are using it. This helps us to improve the way our site works, for example, by ensuring that users are finding what they are looking for easily. Finally, you can find more information about the remaining individual cookies we use and the purposes for which we use them in the list below:

  • Cookies: DirectHeat_ASP.NET_SessionId, TNSMI_DestroyedStateId, DirectHeat_.TNSMIAUTH: Authentication and session management cookies. These cookies are required to identify a user’s session.
  • Cookies: __APPVERSION, ONENTER: Non identifying application cookies.
  • Cookie: GuestInfo: Identifying cookie that is used to store guest user information (to prefill the guest login page and for logging guest access)
  • Cookie: LoginOrigin (AdIntel vs IPAuth vs OIDC etc.): Used to determine how the user authenticated itself.
  • Cookies: AdInsights_AccessToken, AdInsights_IdToken: Identifying cookies that are used to store signed tokens that contain information about the user. These tokens expire.
  • Cookie: AdInsights_ExpirationDate: Non-identifying cookie that is used to remember when the tokens will expire.
  • Cookies: AdInsights_RefreshToken, AdInsights_IdPUsername: Identifying cookies that are used to update tokens when they have expired.
  • Cookie: LatestFederatedConnections: Non-identifying cookie that is used to remember the latest federated connections.
  • Cookie: ReturnUrlForOIDC: Non-identifying temporary cookie that is used during OIDC SSO setup.

You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site.

 

KEEPING YOUR PERSONAL DATA SECURE

We remain responsible for all the personal information we receive hereunder and under DPF and that which we subsequently transfer to third parties acting as agents on our behalf if they process personal information in a manner inconsistent with the applicable principles.

We will take reasonable steps to ensure that your data is treated securely and in accordance with this Privacy Notice. All information you provide to us is stored on our secure servers. We maintain administrative, technical, and physical safeguards designed to protect personal data against unauthorized access, disclosure, alteration, or destruction. These safeguards include, without limitation: (a) limiting access to personal data to employees, contractors, and service providers who have a legitimate business need to access such information; (b) implementing access controls, encryption, and other technical measures designed to protect the integrity of personal data; and (c) requiring our third-party contractors and service providers to implement and maintain appropriate security measures for personal data in their possession. We regularly assess and enhance our security practices to address evolving risks and to help maintain compliance with applicable data protection requirements.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will take reasonable steps to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

 

LEGAL BASIS FOR PROCESSING

We only process your personal data when we have a valid legal basis to do so. Depending on the circumstances, our legal bases for processing include:

(a) Consent: We may process your personal data where you have provided your consent to such processing. You have the right to withdraw your consent at any time.

(b) Contractual Necessity: We may process your personal data where it is necessary to perform a contract with you or to take steps at your request prior to entering into a contract.

(c) Legal Obligation: We may process your personal data where it is necessary to comply with a legal obligation to which we are subject, such as tax, accounting, or regulatory requirements.

(d) Legitimate Interests: We may process your personal data where it is necessary for our legitimate interests or the legitimate interests of a third party, provided that such interests are not overridden by your rights and interests. Our legitimate interests include operating, maintaining, and improving our site and services; ensuring the security of our site; conducting analytics and research; and marketing our products and services.


USES MADE OF THE INFORMATION

We have listed below the ways in which we use your personal data.

  • To ensure that content from our site is presented in the most effective manner for you and for your computer (this is based on our legitimate interest in ensuring that our site is presented to you in the most effective way possible).
  • To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes (this is based on your consent, which you may withdraw at any time).
  • To carry out our obligations arising from any contracts entered into between you and us (this is based on contractual necessity – we need to use your personal data to perform our contract with you).
  • To allow you to participate in interactive features of our service, when you choose to do so.
  • To notify you about changes to our service (this is based on our legitimate interest in keeping you informed about changes to our service).

We may also use your personal data, or permit selected companies to access your personal data, to provide you with information about goods and services which may be of interest to you and we or they may contact you about these by post or telephone. This is based on our legitimate interest, or our group members’ legitimate interest, in providing you with information about our or their goods or services.

 

DISCLOSURE OF YOUR INFORMATION

  • Affiliates. We may disclose your personal data to our group companies or affiliates, which means our subsidiaries, our ultimate holding company and its subsidiaries. We may disclose your personal data to third parties:
  • Business Transfers. We may disclose your personal data to a prospective buyer or seller in connection with any merger, acquisition, sale of assets, or similar transaction involving MediaRadar or any of its affiliates.
  • Clients. When you access or use our services as an employee or authorized user of one of our clients, we may share your personal data, including usage data on an individual or aggregated basis, with such client to the extent required by our contractual relationship with that client or as necessary to provide our services.
  • Legal Compliance and Protection. We may disclose your personal data where required to comply with applicable law, legal process, or governmental request, or to protect the rights, property, or safety of MediaRadar, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

LINKS TO OTHER WEBSITES

Our site may, from time to time, contain links to and from the websites of our partner networks and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

 

HOW LONG WE KEEP YOUR DATA

We are required by law to keep your personal data only for as long as is necessary for the purposes for which we are using it. The period for which we keep your personal data will be determined by a number of criteria, including the purposes for which we are using the information, the amount and sensitivity of the information, the potential risk from any unauthorized use or disclosure of the information, our legal and regulatory obligations, and any applicable statute of limitations. Where you receive services from us pursuant to a written agreement, your personal data will generally be retained for the duration of that agreement and for a reasonable period thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. When personal data is no longer necessary for the purposes for which it was collected, we will delete, anonymize, or securely dispose of such data in accordance with our data retention policies and applicable law.

 

PRIVACY RIGHTS THAT MAY APPLY TO YOU

As a responsible steward of personal information, we recognize the importance of transparency, accountability, and respect for individual privacy preferences. We are dedicated to implementing practices and procedures that safeguard the privacy and security of the personal data entrusted to us by our customers, partners, and other stakeholders.

Subject to applicable law, you may have the following rights with respect to your personal data:

(a) Right of Access: You have the right to request confirmation of whether we process your personal data and, if so, to request a copy of that personal data.

(b) Right to Rectification: You have the right to request that we correct any inaccurate personal data we hold about you and to have incomplete personal data completed.

(c) Right to Erasure: You have the right to request the deletion of your personal data in certain circumstances, such as when the data is no longer necessary for the purposes for which it was collected.

(d) Right to Restriction of Processing: You have the right to request that we restrict the processing of your personal data in certain circumstances, such as when you contest the accuracy of the data.

(e) Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit that data to another controller, where technically feasible.

(f) Right to Object: You have the right to object to the processing of your personal data in certain circumstances, including processing for direct marketing purposes.

(g) Right to Withdraw Consent: Where we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

(h) Right to Lodge a Complaint: You have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work, or where an alleged infringement of applicable data protection law occurred.

ADDITIONAL INFORMATION FOR U.S. STATE PRIVACY LAWS

Annex B hereto provides additional information for residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other U.S. states with applicable privacy laws.

 

CALIFORNIA-SPECIFIC RIGHTS

Subject to applicable law, California residents have those rights set forth in Annex C hereto with respect to their personal information.

 

ADDITIONAL INFORMATION FOR OTHER INTERNATIONAL RESIDENTS

If you are located in a country not specifically addressed in this Privacy Notice, you may have rights under your local data protection laws, which may include the right to access personal data we hold about you, request correction of inaccurate data, request deletion of your personal data where permitted by applicable law, withdraw consent to our processing of your personal data, and lodge a complaint with your local data protection authority. For Canadian residents, these rights are provided under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation, and complaints may be directed to the Office of the Privacy Commissioner of Canada. MediaRadar is committed to respecting privacy rights globally and will respond to requests in accordance with applicable local law. OPPORTUNITY TO ACCESS AND CHOOSE TO LIMIT THE USE AND DISCLOSURE OF PERSONAL DATA

If personal data covered by this Privacy Notice is to be used for a new purpose that is materially different from that for which the personal data was originally collected or subsequently authorized, or is to be disclosed to a non-agent third party in a manner not specified in this Privacy Notice, MediaRadar will provide you with an opportunity to choose whether to have your personal data so used or disclosed. Requests to opt out of such uses or disclosures of personal information should be sent to us as specified in the Contact section below. Certain personal data, such as information about medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, is considered "Sensitive Information." MediaRadar will not use Sensitive Information for a purpose other than those for which they were originally collected or subsequently authorized by the individual unless MediaRadar has received your affirmative and explicit consent (opt-in).

Web Visitors and Users whose Personal Information is covered by this Privacy Policy may submit an Access or Opt-out request regarding their personal information being used by MediaRadar to request disclosure or removal of the types of personal information MediaRadar collects or processes about them in our data products.

Web Visitors and Users may also further request to correct or amend that information where it is inaccurate, or has been processed in violation of the applicable laws and policies.

Specific details of the request must be provided and your identity shall be subject to verification by MediaRadar before personal information may be disclosed. MediaRadar reserves the right to further evaluate the requests based on applicable laws and its business practices.

RECOURSE, ENFORCEMENT, AND LIABILITY

MediaRadar (including its fully owned subsidiaries Competitive Media Reporting, LLC and Winmo Inc.) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. MediaRadar has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. MediaRadar has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Notice and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In addition to our DPF certification, we may also rely on European Commission-approved or UK Government-approved Standard Contractual Clauses as a legal mechanism to transfer personal data from the European Economic Area, the United Kingdom, or Switzerland to the United States, where appropriate.

In compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), MediaRadar commits to resolve complaints about our collection or use of your personal information transferred to the U.S. pursuant to the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF, and Swiss-U.S. DPF. EU, UK and Swiss individuals with inquiries or complaints should first contact MediaRadar at: privacy@mediaradar.com.

MediaRadar has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers for more information and to file a complaint. This service is provided free of charge to you.

With respect to personal data received or transferred pursuant to the Data Privacy Frameworks, MediaRadar is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. See

In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, MediaRadar commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of human resources data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF in the context of the employment relationship.

CHILDREN’S PRIVACY

Our site and services are not directed to children under the age of 16. We do not knowingly collect, maintain, or use personal data from children under 16 years of age, and we do not knowingly collect personal data from children under 13 years of age without verifiable parental consent as required by the Children’s Online Privacy Protection Act (COPPA). If we learn that we have collected personal data from a child under 16 without verification of parental consent, we will take prompt steps to delete that information from our records. CHANGES TO THIS PRIVACY NOTICE

MediaRadar reserves the right to change this Privacy Notice without prior notice at any time, and will do so by posting the updated version on our Site. If we make material changes to the ways in which we use or disclose personal data previously collected from you, we will notify you through our Site, by email, or other communication.

Annex B

Additional Information for US State Privacy Laws

This section provides additional information for residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other U.S. states with applicable privacy laws. California residents have rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). Residents of other states may have similar rights under their respective state privacy laws. To the extent there is any conflict between this section and the remainder of this Privacy Notice, this section controls for residents of applicable states.

Categories of Personal Information Collected. In the preceding twelve months, we have collected the following categories of personal information from or about California residents:

Identifiers, such as name, email address, and IP address.

Commercial information, such as account information and transaction history.

Internet or other electronic network activity information, such as browsing history and usage data relating to your interactions with our site and services.

Geolocation data, such as general location inferred from your IP address.

Inferences drawn from the above categories of personal information, such as preferences, behavior patterns, and usage trends, used to improve and personalize our services.

Professional or employment-related information, such as company name and job title.

The purposes for which we collect each of these categories of personal information are described in the Uses made of the information section of this Privacy Notice.

Categories of Third Parties with Whom We Share Personal Information. We may share personal information with the following categories of third parties: our affiliates and subsidiaries; service providers who process personal information on our behalf; clients, when you access or use our services as an employee or authorized user of one of our clients; and such other parties as described in the Disclosure of your information section of this Privacy Notice.

No Sale or Sharing of Personal Information. MediaRadar does not sell personal information, as that term is defined under the CCPA and CPRA. MediaRadar does not share personal information for purposes of cross-context behavioral advertising. MediaRadar does not process personal information for purposes of targeted advertising, as such term is defined under applicable state privacy laws.

 

Annex C

California-Specific Rights

Subject to applicable law, California residents have the following rights with respect to their personal information:

Right to Know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected such information, the business or commercial purposes for collecting such information, and the categories of third parties with whom we share such information.

Right to Delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions permitted by applicable law.

Right to Correct. You have the right to request that we correct inaccurate personal information we maintain about you.

Right to Opt-Out of Sale or Sharing. You have the right to opt out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising purposes. As stated above, MediaRadar does not sell or share personal information for these purposes; however, you may still submit an opt-out request by contacting us using the information set forth below.

Right to Limit Use of Sensitive Personal Information. To the extent we collect sensitive personal information, as defined under the CPRA, you have the right to request that we limit our use and disclosure of such information to those purposes expressly permitted under the CPRA. We do not use or disclose sensitive personal information for purposes other than those permitted under applicable law.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your rights under applicable state privacy laws. Unless permitted by law, we will not deny you goods or services, charge you different prices or rates, provide you with a different level or quality of goods or services, or suggest that you may receive a different price, rate, or quality of goods or services as a result of your exercising your privacy rights.

Right to Appeal. If we decline to take action on your privacy request, you may appeal that decision by contacting us at privacy@mediaradar.com. We will respond to your appeal in accordance with applicable law.

How to Exercise Your Rights. To exercise any of the rights described above, please submit a verifiable consumer request by contacting us at privacy@mediaradar.com or by writing to us at the address set forth in the Contact section of this Privacy Notice. We may ask you to verify your identity before responding to your request. We will respond to verifiable consumer requests within the timeframes required by applicable law.

Authorized Agents. California residents may designate an authorized agent to submit requests on their behalf. To use an authorized agent, you must provide the authorized agent with written permission to submit requests on your behalf, and we may require you to verify your own identity directly with us and confirm that you have provided the authorized agent with such permission. We reserve the right to deny requests from agents who cannot demonstrate sufficient authority to act on your behalf.

Do Not Track. Our site does not respond to Do Not Track signals transmitted by web browsers. There is currently no accepted standard for how websites should respond to such signals, and we do not alter our data collection or use practices in response to Do Not Track signals.
